Terms of Service

These terms govern use of the Pointer feedback widget (<pointer-feedback>), the Pointer dashboard, the Pointer browser extension, and the Pointer CLI, whether you use the hosted service at pointer.moamen.work or a self-hosted installation your organization runs. For how we handle data, see the Privacy Policy.

1.Acceptance & eligibility

By creating an account, installing the widget, using the browser extension, or otherwise accessing the service, you agree to these terms on behalf of yourself and, if applicable, the organization you represent. You must be legally able to enter into a binding agreement to use the service.

2.Service description

Pointer is a software-as-a-service feedback and annotation tool: a browser widget and extension let people click an element on a running web app and leave a comment; a dashboard organizes those comments by project, environment, and status; and a CLI/skill lets a developer apply the requested change to the real source code using an AI coding tool of their choice. Pointer does not include or operate an AI coding tool itself.

3.Account responsibilities

You are responsible for maintaining the confidentiality of your account credentials and API keys, and for all activity under your account. Notify us promptly if you suspect unauthorized use. Workspace administrators are responsible for who they invite and what roles they grant.

4.Acceptable use

You agree not to:

• use the service to collect data you are not authorized to collect from the people using your product;
• attempt to bypass workspace isolation, rate limits, or authentication;
• reverse-engineer, resell, or white-label the hosted service without a separate agreement;
• use the service to submit unlawful, infringing, or malicious content.

5.Intellectual property

Pointer (the software, branding, and hosted infrastructure) is owned by its operator. You retain ownership of the comments, screenshots, and other content you submit through the service ("your content"). You grant us a license to store, process, and display your content solely to operate the service for you and your workspace.

6.Data processing

How we collect, store, and retain data — including data residency (Oracle Cloud, Riyadh region), retention periods, subprocessors, and your rights — is described in the Privacy Policy, which is incorporated into these terms by reference.

7.Availability & SLA

We aim to keep the hosted service available and responsive, but it is provided on a best-effort basis with no uptime guarantee or formal SLA at this time. Planned maintenance and incidents may cause temporary unavailability. Self-hosted installations are entirely your organization's responsibility to keep available.

8.Limitation of liability

To the maximum extent permitted by applicable law, Pointer is provided "as is" without warranties of any kind, and the operator's total liability arising from your use of the service is limited. 9.Indemnification

You agree to indemnify the operator against claims arising from your misuse of the service or your violation of these terms or applicable law. [LEGAL-REVIEW: confirm the indemnification scope and any mutual indemnification obligations before this clause is finalized for a paying customer contract.]

10.Termination

Either party may stop using/offering the service at any time. We may suspend or terminate an account for a material breach of these terms, including abusive or unlawful use. On termination, your workspace data is handled per the deletion semantics in the Privacy Policy.

11.Governing law & disputes

These terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising from these terms or your use of the service is subject to the exclusive jurisdiction of the courts of Riyadh. [LEGAL-REVIEW: confirm whether a specific KSA court/arbitration body (e.g. SCCA) should be named as the dispute venue, in place of the general Riyadh courts reference above, before this is relied on for a paying customer contract.]

12.Changes to these terms

If these terms change, the updated version will be published at this same URL with a new effective date.
